The Noble Family of Gatto.

who held the fief of Deyr il Bniet (1350 (1st grant),1372 (2nd grant), 1397 (investiture)), the fief of Chimesia  (1397 (regrant), both fiefs described by Abela as baronies together with the third fief/barony of Bucane (1404 investiture in Abela’s opinion probably referring to an earlier grant of 1372 in favour of the Murina family)

This family is listed as a noble family in “Descrittione di Malta” (1647). Moreover this family was later to be granted the titles of Barone di Benuarrat (1737), Illustrissimo e Nobile (1737), Conte di Beberrua (1783). In 1878, the possession, then in the Damico family, of the fief of Djar el Bniet together with that of Bucana was regarded as a basis of a title of Barone personal to the holder of those fiefs. 

“Nobilissima, non meno, ch’ antica e’ stata in Malta questa Casa, ricca di feudi, e d’altri beni stabili, come altresi adorna di principali cariche, e titolo denotanti la sua maggioranza; essendo che Cicco, o sia Francesco Gatto ritrovandosi Castellano del Castello di Malta, vacante allora il feudo di Deyr il Bniet per estintione in quest’ isola della famiglia Bava, fu’ dal Re’ Ludovico onorato di detto feudo per lui, e suoi legittimi eredi discendenti da esso, come si legge nel privilegio speditogli in Messina a4 di Gennaro 1350. Sotto il medesimo giorno esso Re’ privilegiando l’istesso Cicco, e Lanza suo figliuolo, con le seguenti parole, Considerantes fidem puram, & devotionem sinceram, quas Chiccus Gattos Castellanus Castri Insula Meliveti, & Lances Gattus filius eius fideles nostri erga Maiestatem nostram geffurent, & gerunt fatis fideliter, & devote’; nec non grata obsequia per eos culmini nostro praestare poterunt in futurum, auctore Domino, gratiora, qua remuneratione maxima digna sunt, concede loro, & a’ gl’ eredi in perpetuo l’estentione da I pagamenti per tutto il Regno, che si dovessero alla regia Corte, ne piu’, ne meno, come se fussero Cittadino Messinesi. Il quel privilegio fu’ poscia per un altro confermato, e conceduto di nuovo dal Re’ Federico alla domanda di Lanza, nominandolo come segue: Notum fieri volumes universes, tam praesentibus, quam futuris, quod Iudex Lancea de Gatto de Melivento, familiaris, & fidelis noster praesens coram nostrae Maiestatis aspectu contult, & praesentavit Curiae nostrae quddam privilegium, etc Serenissimi Principis Domini Ludovici dicti Regni Regis Illustris charissimi fraters nostris bon, memor & c la cui data fu’ in Malta, ritrovandosi quivi in persona il detto Re’ a’ 12 di Novembre del 1372 concedentogli parimente, e per la linea de’ discendenti da lui il feudo di Deyr il Binet, ch’era vacato per morte di Cicco suo padre, sotto servigio d’un cavallo, come si ravvisa ancora per un altro suo real diploma dato pure in Malta sotto il medesimo giorno. Di questo Lanza Gatto si fa’ memoria in publica scrittura, & atti di Notaro Nicolo’ Cordaro sotti il 2 di Agosto del medesimo anno, ov’ e’ enominato regio Preposito di quest’ Isole. Doppo la di lui morte, succede’ nel feudo Francesco Gatto suo figluolo, e ne fu’ investito dal Re’ Martino in Catania a’ 14 di Febraio 1397, e nell’istesso giorno l’uno e l’altro Martino Regi d’Aragona, e di Sicilia gli donarano per lui, e suoi eredi legittimamente discendenti dal suo corpo, il feudo della Chimisia, iure Francorum, sotto il militar servigio del cavallo confermandogli la concessione o’ sia approvazione di detto feudo a’ suo favour data da D. Guglielmo Ramondo de Moncata, in tempo, ch’ era con giusto titolo possessore di Malta, narrando Francesco, che I suoi Antenati anco prima erano padroni di detto feudo; ma che per le turbolenza delel guerre fin allora occorse in Malta, si erano casualmente perduti I privilegi de’ suoi predecessori, insieme con altri beni, e robbe, che per forza, Artale d’Alagona con le sue, haveva fatto trasportare dentro il Castello, & ivi ritenere violentemente, occupate in poter di lui, allora ribelle. Viene Francesco in questo privilegio nominato in tal modo, cioe’ Prasens in Curia nostra dilectus Algazirus, et Consiliarius, familiaris, et fidelis noster Franciscus Gattus de Civitaate Meliveti Miles. La qual investiture, e nuova concessione, si dice farsi in riguardo de I grati, & accetti servigi da lui fatti alle loro Maesta’, praesertim noviter in recuperatione dictae Civitatis Meliveti, in qua personam suam multis exponendo periculis impavide’ laboravit, quae praestat ad praesens, etc, e come piu’ largamente apparisce in detto privilegio spedito in Catania a’ 14 di Feb, 1397. Pochi anni appresso, il medesimo Francesco havendo (oltre le due gia’ dette Baronie) quella ancora di Bucane, che gli apparteneva come marito di Paola di Castelli (originata al parer nostro dalla famiglia Murina, per essere stato donato questo feudo l’anno 1372 dal Re’ Federico a’ Guglielmo Murina Maltese) e non ritrovandosi haver figluoli maschi, ma solamente una femmina; ottenne gratia dal predetto Re’ Martino di poter lasciare li feudi nel modo infrascritto, cioe’ che venendo a’ morte senza figli legittimamente discendenti dal suo corpo, potesse donare anco nell’estremo di sua vita, ad un fratello, o’ ad altri suoi consanguinei discendenti da suoi padre, e madre li due feudi, come di sopra havuti da suoi progenitori, o’ da loro acquistati: e che il feudo di Bucane dotale della moglie, havesse ella facolta’ (in caso di morte parimente senza eredi dal corpo suo) di lasciare si’ al marito, come a’ quei della parentela discendenti da suoi genitori, o’ a’ quelli della di lui stirpe, secondo piu’ direttamente si legge nel privilegio spedito in Catania l’anno 1404, a’ 15 d’Aprile, nel quale in tal guisa vien egli qualificato, e nominato, cioe’ Praesentis itaq, privilegii serie notum fieri volumes tam praesentibus, quam futuris, quo ad humilem supplicationem per dilectum Consiliarium nostrum Franciscum Gattum de Insula Meliveti miltem, nostris culminisbus inde fastam, nouise afferentem fa unicam domtaxa habere filiam de eius corpore legittime’ descendente, etc. La quale unica figluola, ch’ haveva nome Imperia, fu’ collocate in matrimonio con Antonio Desguanez, e tra gl’altri figluoli essedogli nato uno che si chiamo Francesco; fu’ questi dall’Avo Francesco Gatto istituito nel suo testamento erede particolare nel feudo di Chimesia, con espresso patto, e conditione (accio’ non venisse ad estinguersi in tutto il proprio cognomen) ch’egli dovesse portare quello di Gatto con Desguanez insiememente, e l’arme: onde poi per molti anni appresso, I discendenti, e successori da lui, usavano il cognome de Gatt’ Inguanez, e l’arme unite dell’ una, e l’altra casa, secondo si ravvisa in piu’ luoghi della Citta’. Passarano in tal modo li tre feudi nella famiglia Desguanez, due de’ quali ella fin hoggi gode, cioe’ Bucane, e Deyr il Binet; e l’altro della Chimesia, essendo pervenuto a Donna Perna figluola del predetto Francesco Gatt’ Inguanes, entro nella casa Guevara per il di lei matrimonio (come crediamo) con Matteo di questo cognomen, che lo troviamo chiamato Barone di esso feudo nel 1516 poscia nella famiglia Bell’ homo di Siracusa, per esserci indi con Perna ammogliato Cosmo Bell’ Homo intorno all’ anno 1526 doppo ch’ ella era stata anche prima consorte d’Ortensio Spatafora; ippreso in quella d’Inbo; e finalmente comprato dal Sig. Gran Maestro de Paula, fu’ dal medesimo applicator alla sua fondatione di galee. I dianzi nominato Francesco Gatto milite, padre d’Imperia, fu’ creato Capitano di Malta, e Gozo per lo spatio di Cinque anni, come si dimostra per la sua provisione data in Palermo a’ 16 d’Ottobre del 1403. Nel 1417 egli fondo’ la Chiesa di S. Agata dentro la nostra Citta’, co’ l ricco beneficio di Giuspadronato da servirsi per tre Canonici della Cattedrale nell’ obbligo di celebrarvisi una messa in ogni giorno vicendevolmente, con volere, che la nominatione de I tre Canonici spettasse ad Imperia sua figluola, & erede, & a’ gli’ eredi di lei in perpetuo; hoggi pero’ vien servita da un Beneficiato, che si deputa a’ presentatione de I padroni. Visse questo Francesco fin dopo l’anno 1431 nel quale fu’ dal Re’ Alfonso provisione data in Barcelona a’ 17 d’Aprile creato la seconda volta Capitano di Malta, quando egli in servigio di quella Maesta’, e della sua regia Classe fece alla sua proprie spese armare una ben spedita galea. Nel 1419, l’istesso essercito’ l’officio di Giurato, e nell’ anno appresso del 1420 fu’ eletto dal Consiglio della Citta (nominandolo nobilis miles) in compagnia di Ludovico de Plozasco, accio’ a’ nome, e per parte di tutta l’Universita’ di Malta chiedesse dal regio Commissario, allora venuto in quest’ isola alcune cose, che riguardavano il pubblico interesse del Popolo. Gerardo Gatto leggiamo Giurato l’anno 1404 & 1407 il quale stimiamo sia stato fratello di Francesco, e di cui benche non si esprima il nome, si fa’ mentione nel predetto privilegio di poter disporre i feudi dato appunto nell’istesso anno 1404 ” (From Abela’s “Della Descrittione di Malta del Commendatore Abela” (1647))

Footnote #1: Historically, no title of Barone di Djar il-Bniet was ever granted in 1350. Nor was there any grant of a title of Barone di Buqana in 1372. To assert that the title of Barone di Djar il-Bniet et Buqana was granted before the 14th century is a fallacy. According to the 1878 Commissioners, the first relevant dates are 1512 (Buqana) and 1725 (Djar il-Bniet and Buqana). Although Abela describes them as baronies in 1647, it was only in 1878 that the title of “Djar il-Bniet and Buqana” was backdated to 1350. – See footnotes below.

Footnote #2: The two fiefs of Diar el Bniet and of Buqana were never granted as titles in the strict sense. However, the holder of these two untitled fiefs (together) was by custom accorded the personal title of barone. Published sources show these fiefs as having been granted in 1350 in favour of Francesco Gatto and 1404 in favour of Guglielmo Murina, as they in fact were. However, it appears that the first time Buqana (alone) was ever referred to as a title (barone) was only in 1512 in favour of Giacomo Arginaldo Inguanez, whilst the first time the holder of both fiefs was referred to as a barone in a legislative act was in 1725 in favour of Marc’ Antonio Inguanez and his wife the baronessa. It appears that no legislative act ever contemplated a barone di Djar il-Bniet. There is therefore only historic reference to a Barone di Buqana (1512) and a Barone di Djar il-Bniet et Buqana (1725). However, Abela does not indicate how, when, or in whose favour this baronia was created. Historically, no title of Barone di Djar il-Bniet was ever granted in 1350 in favour of the Gatto family. According to the 1878 Commissioners’ Report, the lands of Djar el Bniet (only) were first granted in fief to Francesco Gatto and to the heirs of his body by Louis, King of Sicily (House of Aragon), on the 4th January 1350, by a privilegium given at Messina, the fief having reverted to the Crown after it had been held by Michele Bava. The grant was afterwards confirmed in Malta on the 12th November 1372, by King Frederick, brother of the said King Louis, in favour of Lancea Gatto, son of the above-mentioned Francesco, sub militari servitio unius equi alforati curiae nostrae perinde praestando ; and was once more confirmed by King Martin, at Catania, on the 14th February 1397, in favour of another Francesco Gatto, son of the said Lancea. All of these authentic documents were examined by the 1878 Commission. 

Therefore to assert that the title of Barone di Djar il-Bniet was granted before the 14th century is a fallacy. According to the 1878 Commissioners, the first relevant date for Djar il-Bniet is 1725 year when Marc’ Antonio Inguanez and his wife received the noble titles of Illustrissimo e Nobile where he was addressed as a barone. It was only in 1878 that the title of “Baron of Djar il-Bniet and Buqana” was backdated to 1350 in the person of Cicco Gatto. In fact the Commissioners reported as follows:- “Although this does not appear to have been expressly granted in the diplomas or Privilegia given in 1350 and in 1372, yet there are sufficient grounds for holding that at a later period that title was conferred or recognized, for Grand Master Manoel, on the 30th April 1725, issued a Prammatica or Ordinance, by which in order to remedy abuses and inconveniences, which had for some time prevailed in regard to titles, that Grand Master ordered and commanded that thenceforward no advocate, notary, or attuario should take upon himself to give in any instrument, contract, or other public act drawn up by him, the title of illustrissimo or of noblile to any of the prince’s vassals, with the exception of the Capitano della Verga pro tempore, of the two Magistrati of the cities of Valeltta and Notabile, and the Milite barone Marc’Antonio Inguanez our feudatory, and Baronessa Inguanez his wife, and their descendants. Other nobles who will be mentioned hereafter were subsequently excepted from the provisions of the above Prammatica. Barone Marco Antonio Inguanez is the ancestor of Maria Teresa Damico, the present Baronessa. By the foregoing legislative act he, as the holder of the two fiefs in question, and his descendants were recognized by the former Government as barons. Marc’ Antonio was moreover thirty-four times between the years 1705 and 1760, appointed Capitano della Verga, and always designated as Barone Inguanez”.

However, he does not indicate how, when, or in whose favour this baronia di Bucana was created. According to the 1878 Commissioners’ Report, by another privilegium given at Catania on the 15th April 1404, King Martin confirmed in favour of the said milite Francesco Gatto, not only the possession of the fief of Diar el Bniet, but also that of the fief of Bucana which had been conveyed to Gatto, and had been previously by a privilegium given in Malta on the 4th November 1372, assigned by King Frederick to Gugliemo Murina and his descendants sub servitio unius equi alforati curiae nostrae perinde praestando.

Footnote #4: The British colonial administration understood only two ways of transmitting a title of nobility: “Either personal to the holder of a particular fief, or descends in order of primogeniture to be tenable only by the eldest male descendant”.Therefore on the basis that that Maria D’Amico was verified at the time to be in possession of these fiefs and that she was a descendant of Cicco Gatto, the Royal Commissioners of 1878 concluded that she was entitled to the title of “Baroness of Djar il-Bniet and Buqana”. 

Footnote #5: Fiefs were abolished in Malta 1969 with a savings clause “nothing shall affect any title of nobility, and the laws in force concerning any such titles shall continue to have effect”. The question whether this renders the title transmissible by descent or whether it is extinct is discussed.
